Dear Sir,
We are the owners of different machinery and Equipment required in Construction Division and we supply our Equipment on hiring basis.
We have taken CPM policy for our Piling Rig (Hydraulic Piling Rig) used for boring purpose.
While doing a job in Assam an accident took place where Kelly Bar of our Equipment got struck at the depth of approx 32 meter in the ground and because of that impact Mast also got bent. This incident took place while working.
We have lodge a claim and has been rejected by Insurance Company stating that this is an underground operation and under Clause 'K' and it is not included in CPM Policy.
Please help by giving your expert opinion.

You may start discussions asking them, OK you may not pay this claim to me now, but in future I want it to be covered - suggest me suitable cover.
The underground clause is vague and needs correct interpretation. You tell them that the machine was not operating underground, it was above ground, while only in routine working it got damaged. Why the insurance was done if such claims were to be denied. Claims have been paid in similar situations.
This can not be said as underground. This is Piling rig and as the name depicts as must be read as " making a way to underground" but not working underground.
The Policy terms & condition needs to be understand properly, before commentiong further. Pls Show the comments of surveyor on board regarding damage to MAST.
