The vehicle was insured from 14/02/2010 to 13/02/2011.& vehicle caused with an accident on 27/01/2011.The insured informed the insurer on next day .i.e., 28/01/2011 about accident of vehicle along with all required documents including estimate. But incidentally he had to go outside for some urgent job for about three months,without informing the insurer. so he could not show the vehicle for assessment,.
When he came back,he approached the insurer for claim of his vehicle.The insurer refuses to reappoint a surveyor for the same claim.
My question is,whether the insured can take claim thru court or the law is in favour of insurer.

Your inquiry requires little more of information. What is the reason that vehicle could not be shown to surveyor when insured had even submitted the estimates. It means the vehicle was not given to repairer, and possibly vehicle was taken by the insured where he went for such a lond time. These facts are important to know. In any case the surveyor would have been appointed on the first intimation and he would have given the his report also. Insured would have been given some notice also to produce the vehicle for survey etc etc.
Insurance company has good reasons to repudiate the claim But it does not take away the insured's rights to file a complaint to Consumer courts/ombudsman/civil court. The court shall decide the case on merits.
