Bad remarks/abuses on side of car

During my survey,the insured has mentioned as cause of accident as ,"my car was parked outside the park.Some mischievous children marked some bad remarks/abuses on complete RH side of car.It looks bad,if I drive the car,so car should be repainted."( FIR not arranged)
My question is,
1) can it be treated as accident & cashless facility be provided.
2) is FIR/DD required
3) if it is not an accident,where this can be covered.

The damage is covered under "malicious damage",and requires to be
reported to police. The claim is payable.

The claim is payable cashless also only after reporting to police thru FIR/DD,under malicious damage condition,which is covered in motor policy

It is invariably said for reporting to the police even in cases for other than theft. But go thru the policy, is it mandatory to report to the police. Are the abuses on the car, not self evident of a malicious act. How the insurance company is benefitted by the same. Many of the rules are adopted by the underwriters to avoid the claims or exploit the claimant. But I do not find any mandatory requirements in policy document

The claim is payable. The insured is frank and up right. Let us help a genuine case. I had many occasions to cover such mischievous/ malicious damage cases.

FIR and reporting or NOT, depends on local conditions/ restrictions (in law it is not mandatory) BUT yes one can make a Customer spin around; lest we keep paying such claims as a routine and many in a specified area (location) !! That is why it is termed "malicious". I had a occasion when as soon as I cleared the first case (without police FIR), next claim arose the very next after the IV was repaired and put out of garage. You can take your call on it.
