Theft of my vehicle

I purchased Hero Honda Splendor Plus Motor cycle from dealer in Delhi & got it insured through National Insurance Company. My younger brother Rajesh Kumar had taken the vehicle to his college,who was not having driving licence.The theft occurred within a week of purchase without registration No.Police lodged FIR after 10days.I intimated to the company after I got FIR copy
Except driving licence,I have given all the required papers to the Surveyor. Will I get my claim?

Dear Mr Ramesh

You will certainly get your claim. Your vehicle is not unregistered, the dealer would have given you a temporary registration which is valid for one month and this is the period when you are suppose to get the vehicle registered in the authority you want to get it. Driving licence is not at all a obstruction in theft claims. There are decided court cases in this regard. I am afraid the original documents of the vehicle which are required for registration may be in the M/Cycle and if it is so then this is serious, It is better to talk to insurance company as to how to proceed in the matter. It is better that a formal letter to all the authorities are written that vehicle with this chassis and engine no and this make, is not permanently registered and in case any one applies, the course is informed to owner and police. Send them the FIR photocopy also. In case of any difficulty contact me on phone

You have not mentioned whether you have applied for registration or not. If you have applied, money receipt from Registering Authority will suffice registration problem if you paste a paper in Registration Plate Number -A/F(Applied For)
I understand the theft has taken place from College. Driving License is not so important in that case .
Important point is how much precaution/safeguard you have taken to protect your bike from theft. Was it stolen from parking area?. Insured should take precaution in such a way that he is an uninsured person.
If you can prove enough precaution you have taken to safeguard your bike, you will have no problem of getting compensation
