Kindly give your opinion for CPM Policy claim in which only one machine viz chain mounted Excavator insured, got damaged due to rocksliding during cutting a hill to build up a road, questions are
1. Is the loss falls under the scope of AOG.
2. Driving Lisence/Certificate of training of such type of machine operations required as in such type of operations a lot of skills required.

It is non-AOG Peril and it is an accident only
There are chnaces such vehicles are driven by unlicensed driver as it does not come under Motor Vehicles act. You can insist some sort of training certificate friom the Equipment Manufacturer / supplier / insured stating that he has been trained and working for such time period.

Following is my opinion regarding rock sliding it is covered under AOG. Driving licence is not required. The claim is payable only if the
machine has been damaged at the site mentioned in the policy.
Ecess shall also be applicable as mentioned in the policy.

Rock sliding is obviously an AOG peril. If excavator was in operational,then necessary relevant certificate is needed
I agree 100% to what Shri Rao Saheb has written and this is what is in practice. As far as admissibility of the claim is concerned it is admissible and it is not under the exclusion of AOG. But as far as the issue of D.L or the certificate of training is concern I want to make my opinion as below -
1. These machines had been insured under Motor Policies for a long time and reason of it was that an excavator was used on projects on rental/hired basis and its location use to be changed from one project to other project.and there was a transit of the machine from one place to the other on a plateform carrier. Since the CPM policy is for one location only, it was difficult to insure the excavator for different locations or issue frequent endorsements. Further there is no provision for marine coverage under CPM policy. To manage these two points the excavaters were being insured under Motor Policy and this use to give leverage of multi location and also marine loss in shifting from one location to other. Now in eventuality of a claim there is no provision of licence of such machines and underwriters started demanding the training certificates.
Over a period of time the excavators are being located at one project site only and and are part of CPM policies, which provides insured an advantage of breakdown cover and benefit of reinstatement clause also. But there are excavating machines which are still being insured under motor policies also for the reasons mentioned above. In this mixup of underwriting insurance company demands the machine training certifcate even in Claim under CPM polciy,. Which is not at all a requirement of the CPM policy. In fact we do not demand any such training certificate for any other machine insured under CPM policy. There is a similar mix up in Fire and Engineering policies also that surveyors start deducting 50% depreciation for plastic and rubber parts even if the same is new and loss is under Fire or engg policy. This is also mixing up the terms and conditions of two different policies. Fire and Engineering policies demand deprecciation according to life of the component. Similarly many surveyors do not charge any depreciation on labour charges in Fire and Engineering policy.
So while handling any claim, we have to be careful on the terms and conditions of the policy under which the claim has occurred and we do not need to mix up the conditions of one policy with the other. This has become more important since the de-tariffing regime when the terms and conditions are now mutucally agreed and are not standard. .

The peril does not fall under AOG category. Also we can insist for a trained operator but we can not decline the claim and make nonstandard deduction in case it is being handled by an untrained operator. Regards,
